1. Introduction
These terms govern your use of www.bioaktiva.co.za and any purchase you make from us. By placing an order, you agree to them. They work alongside your statutory rights under the Consumer Protection Act, 68 of 2008 ("CPA") and the Electronic Communications and Transactions Act, 25 of 2002 ("ECTA"), and nothing here limits those rights.
2. Who We Are
Fertile Acre (Pty) Ltd t/a BioAktiva, a company registered in South Africa (Registration No. 2022/507647/07). You can reach us at enquiries@bioaktiva.co.za.
3. Our Products
We sell soil conditioners and related agricultural inputs, and we describe them as accurately as we can. Our products are registered where the law requires, which confirms their composition and lawful sale. Results in your own soil depend on your conditions and on correct use, so please always follow the Label Directions.
4. Prices and VAT
Prices are shown in South African Rand and include VAT at 15% unless stated otherwise. We may change prices at any time, but a change will not affect an order we have already accepted. If a price is shown in obvious error, we may cancel the order and refund you in full.
5. Orders and Acceptance
Placing an order is an offer to buy. A contract forms when we confirm that we have accepted your order. We may decline an order — for example if a product is unavailable, if we cannot deliver to your area, or if we suspect fraud.
6. Payment
We currently accept payment by EFT / bank transfer; our banking details appear at checkout and on your invoice. Card payment via PayFast is being added. Orders are dispatched once payment reflects in our account, unless you hold an approved trade account on agreed terms.
7. Delivery
Delivery is handled as set out in our Shipping & Delivery Policy. Risk in the goods passes to you on delivery; ownership passes once we have received payment in full.
8. Returns and Refunds
Your rights to cancel, return and obtain a refund are set out in our Returns & Refunds Policy, which forms part of these terms and reflects your rights under the CPA and ECTA.
9. Use of the Website
Please use the site lawfully. You may not attempt to gain unauthorised access, disrupt the site, or use it for any unlawful purpose. Content on the site belongs to us or our licensors and may not be copied without permission.
10. Liability
Nothing in these terms limits any liability that cannot lawfully be limited, including under the CPA. Subject to that, we are not liable for indirect or consequential loss, or for loss arising from a failure to follow the product Label Directions or to use the product as intended.
11. Privacy
We handle your personal information in line with our Privacy & POPIA Notice.
12. Governing Law
These terms are governed by the law of the Republic of South Africa, and the South African courts have jurisdiction.
